Terms of service

This document governs the relationship between Rally.Build (“we”, “us”, “our”) and the customer (“Buyer”, “you”). By accessing our website or web services, placing an order, or visiting or purchasing from our physical storefront(s), you agree to be bound by these terms.

1. Motorsport Assumption of Risk and Liability

All products sold by Rally.Build are intended for off-road, closed-course competition use only, unless explicitly labeled otherwise.

  • Assumption of Risk: The Buyer acknowledges that motorsport and racing are inherently dangerous activities. By purchasing, you expressly assume all risks, known and unknown, associated with the use, installation, and performance of these products.

  • Disclaimer of Warranty: Due to the extreme conditions under which these products operate, Rally.Build and its vendors provide no warranty, express or implied, for products used in competition or high-stress environments unless otherwise explicitly stated.

  • Installation: Professional installation by a certified technician is strongly recommended. Rally.Build is not liable for any damages, injuries, or deaths resulting from improper installation of any products purchased from us.

2. Special Order Policy

Items marked as “Special Order” or “Non-Cancellable” on the product page, invoice, or through written communication are subject to specific terms that supersede any conflicting terms found elsewhere in our terms of use or return policies.

  • 24-Hour Cancellation Window: You may cancel a Special Order item for a full refund for any reason within 24 hours of order placement. 

  • Finality of Sale: After 24 hours, Special Orders are processed with our international vendors and cannot be cancelled for any reason. Rally.Build reserves the right to apply a cancellation fee of 100% of the order value for any cancellation attempts made in violation of this policy.

  • Estimated Lead Times: All lead times provided, whether via product page, invoice, quote, or written or verbal communication, for Special Order items are estimates only. While we strive for accuracy, international logistics, customs clearance, and manufacturing delays are outside our control. Delays do not entitle the Buyer to a refund or cancellation.

3. Tariff and Duty Policy

Special Order items imported from abroad are subject to the following floating tariff policy. While we strive to include accurate and up-to-date tariff, duty, and freight charges into our published pricing, quotes, and written or verbal communications, the international trade environment is volatile.  The Buyer agrees to the following floating tariff policy for any and all Special Order items:

  • Basis of Pricing: Prices and quotes provided by Rally.Build include an estimate of import duties, fees, tariffs, and freight. We will publish or communicate the Estimated Tariff Rate at the time of purchase. Note: This estimate covers specific trade tariffs and does not include general duties assessed via the Harmonized Tariff Schedule (HTS), which are considered static.

  • Tariff Reductions: Should the actual tariff rate at the time of customs clearance decrease compared to our estimate, Rally.Build will refund the difference to your original payment method.

  • Tariff Increases: Should the actual tariff rate at the time of customs clearance increase by more than 5% over the original estimate, the Buyer agrees to pay the difference in excess of that 5% margin. These charges will be issued via a follow-up invoice. Rally.Build reserves the right to withhold shipment until the follow-up invoice is paid in full. Unpaid invoices may be forwarded to collections in accordance with local laws and regulations.

4. Headings

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

5. Changes to Terms of Services

You can review the most current version of the Terms of Service at any time on our web site at this page.  Rally.Build reserves the right to update, change, or replace any part of these Terms of Service at our sole discretion.  We will notify you of any material changes to these Terms in accordance with applicable law.  Your continued use or access to the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
